Terms and Conditions of Sale
Overview
These Terms & Conditions govern the sale of goods by Fabric & Design Pty Ltd, trading as Nerida Hansen / Nerida Hansen Creative (“we”, “us”, “our”), through this website. By placing an order with us, you acknowledge that you have read, understood, and agreed to be bound by these Terms. These Terms operate in conjunction with your statutory rights under the Australian Consumer Law (ACL), which remain unaffected.
Our Products
We specialize in premium textile products, including:
• Fabrics sold by the metre or custom cut lengths
• Pre-cut fabric pieces and remnants
• Clearance and liquidation stock
• Textile-related accessories and goods
All products are subject to availability and may be withdrawn at any time.
Fabric Sales and Custom Cuts
Orders and Continuous Lengths
Fabrics are cut to your specific requirements. Whenever possible, multiple units of the same fabric will be supplied as a single continuous length. However, due to roll limitations or stock availability, we reserve the right to supply fabric in separate cuts when necessary.
Custom-Cut Items (Important Information)
Please note that fabrics purchased by the metre, half-metre, or other custom lengths are prepared specifically for your order. Consequently, these items are considered customised goods and are not eligible for return or refund due to a change of mind. This policy applies to incorrect quantities selected during checkout, changes in personal preference or project direction, and expectations regarding colour, weight, or texture.
To ensure total satisfaction, we strongly recommend ordering a sample (where available) prior to purchasing larger quantities.
Pricing, Payment, and Shipping
Orders and Pricing
• All prices are quoted in Australian Dollars (AUD) unless specified otherwise.
• Prices and availability are subject to change without prior notice.
• Your order is confirmed only once full payment has been successfully processed.
We reserve the right to cancel any order due to pricing errors, inventory discrepancies, or suspected misuse of our service.
Shipping and Delivery
Shipping costs are calculated and displayed at checkout. Delivery timeframes provided are estimates only and may be influenced by carrier delays, customs processing for international orders, or peak dispatch periods. Risk and title in the goods transfer to the customer once the order has been dispatched from our facility.
International Orders
• Customers are responsible for all import duties, taxes, and local customs charges.
• We are not liable for any delivery delays caused by customs clearance procedures.
Returns and Consumer Rights
Australian Consumer Law Guarantees
In accordance with the ACL, you are entitled to a repair, replacement, or refund if a product is found to be faulty, defective, of unacceptable quality, or fails to match the provided description or intended purpose. These rights are non-excludable.
Change of Mind Policy
Consistent with retail standards for custom products, we do not offer refunds or exchanges for change of mind, incorrect selection, or over-ordering.
Faulty or Incorrect Items
If you believe you have received a faulty or incorrect item, please contact us at info@neridahansen.com within 7 days of delivery. Please include your order number, a detailed description of the issue, and high-quality photographs of the product and packaging. We will assess your claim and provide a suitable remedy in line with our legal obligations.
Fabric Variations and Usage
Natural Characteristics
Textiles are subject to natural and manufacturing variations. These are not considered defects and include slight colour variances between dye lots, variances in digital screen representation, and minor irregularities in weave or print alignment.
Product Suitability
Customers are responsible for ensuring a fabric is suitable for their specific project or end-use. We recommend performance testing on a small piece before proceeding with large-scale production.
General Terms
Intellectual Property
All content, designs, prints, and materials on this website are the property of Nerida Hansen and are protected by copyright laws.
Liability
To the maximum extent permitted by law, our liability is limited to the replacement or refund of the goods supplied.
Governing Law
These terms are governed by and construed in accordance with the laws of Victoria, Australia.
